Cross Border Estates
More and more individuals have Estates which include assets overseas. We are also increasingly meeting with Clients who have moved over to this country from Europe and beyond or Clients who were born in the UK but who are now living overseas.
Our team of expert Solicitors are highly experienced in preparing Wills for Clients with overseas assets or international connections, advising Clients in relation to their tax position where they have cross border connections and dealing with Estates where there are assets located overseas or where the Deceased had assets here, but they are not domiciled here for Inheritance Tax purposes.
Importantly, we also know the limits of our own legal jurisdiction. Probate & Cross Estate Administration
Many Estates now have a cross border element.
We are increasingly dealing with Estates where the Deceased was domiciled here but their Estate includes assets located overseas or Estates where the Deceased has moved to the UK from abroad and has assets both here and abroad and we need to determine their domicile position for Inheritance Tax purposes and for succession purposes. Our Solicitors are able to assist with the vast majority of those Estates.
We can assist the Personal Representatives of the Estate by doing the following:-
- Obtaining a Grant of Probate in England and Wales to deal with assets in the UK.
- Assisting with the reseal of a UK Grant of Probate/Letters of Administration in countries where it is possible to reseal a UK Grant.
- Advising on the Domicile of the Deceased individual and the effect of that for Inheritance Tax purposes.
- Providing HMRC with a thorough and robust analysis of the Deceased’s domicile position.
- Calculating UK Inheritance Tax and dealing with the UK Income Tax and Capital Gains Tax reporting.
- Liaising with lawyers overseas and acting as a single point of conduct to make the administration of the Estate more straightforward.
- Assisting with the distribution of the Estate to the correct beneficiaries, taking into accounts the rules of different jurisdictions.
International & Cross Border Tax
- Preparing a Domicile Opinion for clients which can be produced to HMRC on an individual’s death to support the Domicile position they are asserting.
- Advising individuals on their Inheritance Tax position.
- Advising individuals on the non-domicile changes coming in on 6 April 2025.
International & Cross Border Estate Planning & Wills
- It is possible to draft a Will to cover worldwide assets, to cover just England and Wales or to cover worldwide assets excluding assets in one or more specific countries.
- We will meet with you at one of our offices or by Teams/Zoom to obtain details of your background, your current circumstances and what you are looking to achieve and then we can advise you on how best to structure your Will to give effect to your wishes.
- We can advise on your Inheritance Tax position and the effect this will have on your death.
