The GDPR is the single biggest change to the data protection legal landscape in 20 years and seeks to give individuals further rights in relation to their personal data and redress the shortcomings of the previous legislation; which was not keeping up with the way in which the modern world was using our personal data.
The GDPR presents a compliance challenge for organisations using personal data. Those organisations are well advised to ensure they are compliant as the fines for breaching the GDPR are 4% of annual worldwide turnover or €20million (whichever is higher). Businesses will also need to be aware of the increased chance that disgruntled employees, customers or third parties will use the GDPR to leverage their position against the business in any claim and therefore compliance is essential.
Some of the key changes the GDPR brought in include an amended definition of consent to processing personal data, increase rights for the data subject such as requesting the erasure of personal data held about them, and a requirement for the organisation to demonstrate they are compliant with GDPR if requested.
Whilst the GDPR can be viewed as a compliance headache for businesses, many of our clients have chosen to see it as a positive and a logical step to better serve their employees and customers alike. We have worked with businesses of all sizes to advise them on the compliance process and the legal documentation to assist in demonstrating that compliance.
