Example cases

Advising on large scale outsourcing and TUPE applications

Herrington Carmichael were instructed to advise in relation to the outsourcing of the client’s legal services division, to a firm of solicitors. TUPE applied to this transfer and Herrington Carmichael provided comprehensive advice on the effect and implementation of the relevant obligations.

Defending a race and disability discrimination claim

Herrington Carmichael were instructed to advise on and defend a claim made by a former employee in relation to race and disability discrimination. Herrington Carmichael aggressively defended this claim and reached a conclusion which was beneficial to the client.

Redundancy and Reorganisation

Herrington Carmichael were instructed to advise on a full group restructure, including being involved with the strategy for the restructure and the implementation of this. This process included circa 100 redundancies, which Herrington Carmichael were able to guide the client through.

Advising on and issuing a group action

Herrington Carmichael were instructed by 288 former employees of the insolvent law firm, KWM LLP. Herrington Carmichael successfully pursued this matter on behalf of the group of employees to recover up to eight weeks’ pay per employee from the Insolvency Service.
