Complaints Resolution

We hope that you will not have any problem with the service we provide for you, but if you do have a complaint about the service you have received or about the invoice, then please let us know as soon as possible. We operate an internal complaints handling procedure and will try and resolve any problem quickly.

If the person handling your matter cannot assist, the matter will be referred to Alistair McArthur, Client Care Partner, to resolve the problem.

Alternative complaints bodies (such as ProMediate) exist which are competent to deal with complaints about legal services should both you and Herrington Carmichael LLP wish to use such a scheme.

We do not agree to use ProMediate.

What to do if we cannot resolve your complaint

The Legal Ombudsman (“the LeO”) can help you if we have been unable to resolve your complaint within the time frame detailed in the Complaints Procedure.

Before accepting a complaint for investigation, the LeO will check:

that you have tried to resolve the complaint with us in the first instance;

and

whether you have suffered significant financial loss, distress, inconvenience or detriment which deems it proportionate for them to investigate.

We will always be happy to discuss your issues further, prior to you going down this route, if you wish to do so.

Any complaint to the LeO must usually be made within six months of the date of our final written response to your complaint. You should also be aware that the Ombudsman will consider the complaint if you refer it on to them within either of the following:

  • One year from the date of the act or omission being complained about;

OR

  • One year from the date when you should reasonably have known that there was cause for complaint.
