Frances specialises in commercial and civil litigation for both businesses and individuals. This includes contract disputes, residential and commercial property disputes and Court proceedings and inheritance disputes. Frances regularly assists professional clients as part of our Healthcare team and is a specialist in assisting with challenging care funding decisions by CCGs in respect of Continuing Healthcare Funding.
Our team’s focus is on resolving disputes, whether through negotiation, mediation or the Court systems with careful consideration of the overall objective – be it payment at all costs, preservation of an on-going relationship or something in between. Court should be a last resort, but is one we prepare for from day one – preparation is key.
Experience / recent projects
Acted for an international telecoms provider whose customer claimed fraudulent activity on their line. The customer’s IT provider had failed to secure the IT system from vulnerabilities, and we settled the claim for more than £35,000 before Court proceedings were issued.
Successfully defended a claim against a group of shops by a national recruiter who was looking for a success fee for an employee who was not suitable and stayed less than 2 months. Procedural errors and contractual loop-holes were highlighted to reach settlement with only a nominal payment being made.
Acted for a residential block management company in the successful implementation of a contested section 20 notice procedure to undertake desperately needed roof maintenance works. The dispute amongst leaseholders had been on-going for nearly a decade before our involvement, but was resolved with a forensic approach to documentation and detailed explanation to the leaseholders.
Obtained possession of a residential property for a well-known celebrity couple without press attention.
